Terms of Service
Plain-English Summary: Dad Saves Money is a desktop budgeting tool, not a financial advisor. The app is currently in beta, provided free of charge. Your data stays on your computer and is your responsibility. We do our best to make it great, but it's provided "as is" with no guarantees.
1. Who We Are
Dad Saves Money ("the App") is developed and published by Emergent Order Foundation, a 501(c)(3) non-profit organization ("we," "us," "our"). The App is part of the Dad Saves America initiative.
By downloading, installing, or using the App, you ("you," "the User") agree to these Terms of Service ("Terms"). If you do not agree, do not download or use the App.
2. The App Is Not Financial Advice
Dad Saves Money is a budgeting and financial tracking tool. It does not provide financial, investment, tax, legal, or accounting advice of any kind.
The App is designed to help you organize, track, and plan your personal and business finances. Any calculations, projections, summaries, charts, reports, or other outputs generated by the App are for informational and organizational purposes only and may contain errors or inaccuracies.
You should not rely on the App as a substitute for professional financial advice. Before making any financial decisions, consult with a qualified financial advisor, accountant, tax professional, or other appropriate expert.
We make no representations or warranties regarding the accuracy, completeness, or reliability of any financial calculations, projections, or information presented by the App.
3. Beta Software & Trial Period
3.1 Beta Status
The App is currently in beta testing. This means:
- The App may contain bugs, errors, or unexpected behavior.
- Features may be incomplete, changed, or removed without notice.
- Data loss is possible. You should maintain your own backups outside the App.
- Performance may vary across different systems and configurations.
3.2 Trial Period
The App currently includes a 60-day free trial with all features unlocked. After the trial period expires:
- Access to some or all features may be restricted.
- Your data will not be deleted, and you will retain the ability to export your data.
- If the trial expires before a paid version is available, contact support@dadsavesmoney.com and we will work with you to extend access.
3.3 Future Pricing
We intend to introduce paid pricing for the App in the future. When paid pricing is introduced:
- It will be a one-time purchase, not a subscription.
- Existing beta users will be notified in advance.
- We reserve the right to set pricing at our sole discretion.
4. License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on computers you own or control, for personal and/or business budgeting purposes.
You may not:
- Reverse-engineer, decompile, or disassemble the App.
- Modify, adapt, or create derivative works based on the App.
- Distribute, sublicense, lease, rent, or lend the App to third parties.
- Use the App for any unlawful purpose.
- Remove or alter any proprietary notices, labels, or marks on the App.
5. Your Data & Responsibility
5.1 Local-Only Storage
The App stores all data locally on your computer. We do not have access to, collect, transmit, or store any of your financial data. This means:
- You are solely responsible for your data. If your computer is lost, stolen, damaged, or if data is accidentally deleted, we cannot recover it.
- You are responsible for maintaining your own backups. The App includes automatic backup features, but these backups are also stored locally.
- We strongly recommend keeping backup copies on a separate drive or storage device.
5.2 CSV Imports
When you import bank transaction data via CSV files, you are responsible for the accuracy and security of those files. The App processes CSV files locally and does not transmit their contents anywhere.
5.3 No Bank Connections
The App does not connect to any banks, financial institutions, or third-party financial services. It will never ask for your banking credentials.
6. Automatic Updates
The App may check for updates from our servers. These update checks transmit only the information necessary to determine whether an update is available (your current app version and operating system). No personal or financial data is transmitted during update checks.
You may disable automatic updates in the App's settings. We recommend keeping the App updated for the latest bug fixes and features.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Any warranty that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- Any warranty regarding the accuracy, reliability, or completeness of any content, data, calculations, or information provided by the App.
Because the App is in beta, you acknowledge that it is more likely to contain defects than a finished product and you accept the associated risks.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- Emergent Order Foundation, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of revenue, financial losses resulting from reliance on the App's outputs, or damages resulting from the use or inability to use the App.
- Our total aggregate liability for any claims arising from or related to the App or these Terms shall not exceed the amount you paid us for the App (which, during the free beta period, is zero dollars).
- These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless Emergent Order Foundation and its directors, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or any financial decisions you make based on information provided by the App.
10. Intellectual Property
The App, including its design, code, graphics, logos, and documentation, is owned by Emergent Order Foundation and is protected by copyright, trademark, and other intellectual property laws. "Dad Saves Money" and "Dad Saves America" are trademarks of Emergent Order Foundation.
Your data remains yours. We claim no ownership over any financial data, budgets, or other content you create using the App.
11. Eligibility
You must be at least 18 years of age to use the App. By using the App, you represent that you are at least 18 years old. The App is not intended for use by children under 18.
12. Termination
You may stop using the App at any time by uninstalling it from your computer. Your data will remain on your computer unless you manually delete it.
We reserve the right to terminate or suspend your license to use the App at any time, for any reason, with or without notice. Upon termination, you must cease all use of the App and destroy all copies in your possession.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
For significant changes, we will make reasonable efforts to notify users through the App or our website.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or the App shall be resolved in the state or federal courts located in Travis County, Texas.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Emergent Order Foundation regarding the App and supersede any prior agreements.
